To the fullest extent permitted by Dutch law, swashboanr B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability for any claims arising out of or relating to these terms or our services shall not exceed the amount paid by you to swashboanr for the specific service giving rise to the claim in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless swashboanr B.V., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services or violation of these Terms of Service.
Either party may terminate the service relationship at any time with appropriate notice as specified in individual service agreements. We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for any breach of these Terms of Service. Upon termination, your right to use our services will cease immediately, but provisions regarding intellectual property, limitation of liability, and governing law will survive termination.
swashboanr shall not be liable for any failure or delay in performance of our services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, or technical failures of third-party systems.
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms of Service. We recommend that you review these terms periodically for any updates.
These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. The parties agree to submit to the jurisdiction of the Dutch courts for the resolution of any disputes.
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Service will otherwise remain in full force and effect and enforceable.
These Terms of Service, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and swashboanr B.V. regarding the use of our services and supersede all prior agreements and understandings, whether written or oral.
